TERMS & CONDITIONS


“Peace of Mind” offer is valid to Rawson Communities Pty Limited (Communities) customers buying a house and land package on selected lots from Communities and who build with Rawson Homes Pty Limited (Rawson).

This promotion is available to all new customers who pay a reservation fee of $2,000 after  22 September 2018 and exchange the land and building contracts by no later than 15 November 2018 for house and land package  on a selected lot at a Communities (or related party) estate, and who proceed to (i) unconditionally exchange a land contract with Communities and building contract with Rawson and (ii) pay the requisite deposits under both of those contracts,  the earlier of (i) twenty one days of reservation of the lot (notwithstanding when the land or building contracts are issued) and (ii) 15 November 2018 and settle on the purchase of the land for unregistered lots within the later of (i) fourteen days of registration or (ii) thirty days after exchange and for registered lots within thirty days of exchange of land contracts, time being of the essence.

A “new customer” refers to anyone who has not yet paid a reservation fee to secure a house and land package from Communities.

“Selected lot” refers to: Lots 330, 354, 356, 357, 358, 360, 363 and 368 Horizon, Marsden Park, Lots 135, 136 and 141 Aspect, Fifth Avenue Austral, Lots 401 and 405 North Kellyville and Lots 210, 229 and 239 Half Moon, Schofields.

This offer is not applicable for house and land packages at Orchid Lane, Leppington, Seaside, Fern Bay, and lots at Aspect Fifth Avenue Austral and Horizon, Marsden Park which are not a ‘selected lot’ or land only lots at any of the Communities estates.

This offer is not valid in conjunction with any other promotion, discount or offer available from either Communities or Rawson, including but not limited to the Unwrap Your Way to $15K and/or the Stamp Duty on Us! Promotion.

Finance: We can arrange your loan – If you choose to be in contact with Mint Loans, your full financial situation would need to be reviewed prior to acceptance of any offer or product. Mint Loans Trust ABN 35 634 683 032 is a Credit Representative 500358 authorised under Australian Credit Licence 389328.

Deposit: Just 5% of the land price - The vendor of the land has agreed to accept the payment of the 10% land deposit, via instalments with 5% of the land price to be paid on exchange and the balance 5% to be paid on the earlier of (i) settlement of the land or (ii) in the event of breach of the land contract by the purchaser, termination of the land contract.

Stamp duty: We pay it for you – The stamp duty will be paid by way of a settlement adjustment in the purchaser’s favour at settlement of the land contract, the adjustment sum will be equal to the amount of stamp duty payable under Chapter 2 of the Duties Act 1997 in respect to the price stated on the front page of the land contract between the vendor of the site and the purchaser (excluding any surcharge purchaser duty, aggregation, interest, or penalty tax or duty, or duty arising from any novation or assignment of the contract). The “Peace of Mind” offer is conditional upon the purchaser completing the land contract for the purchase from Communities for unregistered lots within the later of (i) fourteen days of registration or (ii) thirty days after exchange and for registered lots within thirty days of exchange of land contracts, time being of the essence. Customers participating in this offer agree to disclose the terms of the “Peace of Mind” offer to any bank or other financial institution from which they are obtaining finance for the purchase and to any relevant Government Authority. The customer agrees to indemnify Communities and Rawson from any liability arising from the failure to disclose the terms of this offer.

Completion: $10,000 after your home is built – to be eligible the purchaser must complete the land contract for the purchase from Communities for unregistered lots within the later of (i) fourteen days of registration or (ii) thirty days after exchange and for registered lots within thirty days of exchange of land contracts, time being of the essence. To claim this completion payment, the purchaser must complete and submit to Rawson the ‘Peace of Mind: $10,000 completion claim form’ once the final progress claim has been paid and hand over of the home by Rawson has occurred. All claim forms must be submitted within six months of the date of hand over by the home by Rawson otherwise the purchaser is deemed to have withdrawn from the offer and the $10,000 is forfeited.

“Peace of Mind” offer is only provided to those clients who meet these terms and conditions and unconditionally exchange a land contract and building contract at a selected Communities estate with Rawson, and complete settlement on the purchase of that block of land and otherwise comply with the terms and conditions of the land contract and building contract.

Communities standard land contract conditions and Rawson standard building contract conditions apply.

Communities reserves the right to amend these terms and conditions at any time. Furthermore, Communities reserves the right to extend, change or terminate the “Peace of Mind” offer at any time without prior notice.

Communities reserves the right to use their sole discretion to extend the twenty one day deadline to exchange contracts and pay the requisite deposits. Each such request will be considered on a case by case basis, and the decision of the General Manager of Communities is final and no correspondence will be entered into regarding their decision.

Any photographs, artist impressions and other pictures associated with this promotion, and all other collateral, print materials, website and online products of Communities, and Rawson are for illustrative purposes only.

Participation in this offer is deemed acceptance of these Terms and Conditions.
